These Terms of Service ("Terms") are an agreement between you and the Neon Pop development team ("we", "us")
governing your use of the mobile game Neon Pop ("the Game"), application ID
com.paynetim.neonpop. By downloading, installing or playing the Game you agree to these Terms. If you do not
agree, please do not use the Game.
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the Game on devices you own or control, for your own non-commercial entertainment. All rights not expressly granted are reserved.
The Game asks you for a display name. It is stored on your device and is not shown to any other player. The only way it reaches us is if you choose to send us a message with the in-game Feedback button, which pre-fills it.
We may update, change, suspend or discontinue the Game or any game mode at any time. Should the Game gain online features in a future version, those features will depend on third-party services and on your internet connection, and we will not be able to guarantee uninterrupted availability.
The Game contains optional rewarded video advertising and no paid content. Watching an ad is always your choice. Rewards granted for watching an ad exist only inside the Game and have no monetary value. Ads are supplied by third parties; we do not control their content and are not responsible for the products or services they promote. If we introduce in-app purchases or virtual items in a future version, they will be licensed to you rather than sold, will have no monetary value outside the Game, will not be exchangeable for real money, and will be governed by additional terms presented at the time of purchase together with the refund policy of the app store you purchased through.
Our handling of information is described in our Privacy Policy, which forms part of these Terms.
The Game, including its code, artwork, music, sound effects, text and branding, is protected by copyright and other intellectual-property laws and remains our property or that of our licensors. Feedback you send us may be used to improve the Game without any obligation or payment to you.
The Game is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be error-free or uninterrupted.
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of your use of or inability to use the Game. Where liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us for the Game in the twelve months before the claim, or USD 10.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law that applies to you — for example, liability for death or personal injury caused by negligence, for fraud, or your statutory consumer rights.
You may stop using the Game at any time by uninstalling it. We may revoke the licence granted in Section 1 if you breach these Terms. Should the Game gain online features in a future version, we may also suspend or terminate your access to them on the same basis. Sections 7 to 9 survive termination.
We may revise these Terms as the Game evolves. We will update the "Last updated" date above, and material changes will be announced in the Game or on its store listing. Continuing to play after a change takes effect means you accept the revised Terms.
These Terms are governed by the laws of the jurisdiction in which the Developer is resident or established, without regard to conflict-of-law rules. If you are a consumer, this does not deprive you of the protection of the mandatory consumer laws of your country of residence, and you may bring proceedings in the courts of that country.
